Killer's First Appeal Denied

A judge has denied convicted killer Anthony “Rocco” Franklin’s attempt to get a new trial in 2012 murder of his son-in-law Frank Spencer in Hemlock Township, Columbia County. Franklin’s attorney argued that the prosecution’s timeline of the crime was impossible. He also argued that a blood spot found on the victim’s clothes was never tested for DNA which might have pointed to a different person as the killer. Franklin also again insisted the trial should have been moved outside of Columbia County. Senior Judge David Grine denied all of the arguments. Frankin is expected to appeal to State Superior Court. Franklin is serving a life sentence plus 45 years in prison for the murder. His daughter, Maria Sanutti-Spencer, who was also convicted in Spencer’s murder is also serving a life sentence.
